This document establishes the rules under which you, as a Trademark right holder (hereinafter “You” or “Your”) may use the Uni Extended Protection Service’s Variant Calculator as developed and provided by Uniregistry Corp (“Uniregistry” or “We”).
1. The Service
Uniregistry has created the Extended Protection Service (“EPS”) to allow trademark holders to block the string composed by an official trademark they have successfully registered in the Trademark Clearinghouse (“TMCH”). Trademark holders can register equivalent forms of their trademark (e.g. “one and two”, “one-two” and “one&two”) in the TMCH as individual labels (“Label”). While the Uni EPS version of the Service allows the trademark holder to choose a Label to be blocked, the Uni EPS+ version of the Service blocks all the Labels attached to the trademark as stored the TMCH. Uni EPS+ goes further by automatically calculating possible variations of the Labels that are not identical but confusingly similar to the trademark. To that end, Uniregistry will automatically compute a list of such names based on the confusable characters list published by the Unicode Consortium (http://www.unicode.org/Public/security/latest/confusables.txt) (collectively, “the Computation”). The Variant Calculator, accessible at https://UniEPS.help is a tool created by Uniregistry to allow trademark holders to assess the result of the Computation for their own trademark or Label (collectively “the Service”) and see the number and type of variants that can be created (“the Output”).
2. Demo Service – No warranty
You understand that the Service is only provided as an evaluation tool to help You understand how many confusingly similar versions of the Labels could be generated by the Computation. You agree that, as the algorithm of the Computation may evolve from time to time, the Output shall not constitute any obligation on Uniregistry’s part to offer any service linked to, or based on, the Output, unless specifically agreed between You and Uniregistry as part of the Uni EPS Service Agreement. Similarly, You understand and agree that Uniregistry provides the Service on an “as is” and “as available” basis, without any warranties or guarantees of any kind, whether express or implied, including, but not limited to, warranties of fitness of purpose, noninfringement, or any implied warranties arising out of a course of performance, dealing or trade usage. Uniregistry does not make any representation that its web site will be uninterrupted or error-free, and Uniregistry will not be liable for the consequences of any interruptions or errors in connection with the Service.
3. Access to the Service – Privacy
